2026 Key Rule: Under Dubai Law No. 26 of 2007 (amended by Law No. 33 of 2008) and the 2026 Smart Rental Index rules, a landlord who fails to give written notice at least 90 days before contract expiry loses the legal right to increase rent or change terms for that renewal cycle — even if the Smart Rental Index would have permitted an increase. Even if the notice was valid (written and on time), the proposed increase must still comply with the Smart Rental Index for your building. Open the Dubai REST app, find your building, and check whether any increase is legally permitted and by how much.

Send a written response — email is fine. If the notice was invalid (late or verbal), state clearly that no increase is permitted for this cycle and reference Dubai Law No. 26 of 2007 Article 14. If the proposed amount exceeds the Smart Rental Index cap, attach your index PDF and reject the excess.

Negotiate or Escalate

If the landlord accepts your position, confirm the agreed new rent (or same rent) in writing before signing any new contract. If the landlord continues to insist on an invalid or above-cap increase, file at the Rental Dispute Centre (RDC) via rdc.gov.ae — most clear notice-period violation cases are resolved within 14–30 days in the tenant's favour.

Continue Paying Your Current Rent

While a dispute is ongoing, continue paying your current rent on time. Never withhold rent during an RDC dispute — this weakens your case. Pay into escrow if directed by the RDC. Keep receipts or bank transfer records for every payment.
